COLUMBUS, Ohio - A chimpanzee attacked a student at an Ohio State
University animal research facility, and the woman sustained minor
injuries, officials said.

Sarah, an 80-pound chimp, pulled the woman close to her cage Sunday and
bit her, school spokesman Earl Holland said. Officials didn't know what
prompted the attack.

The victim, whose name and age weren't released, was treated at
Riverside Methodist Hospital.

Sarah, born in the wild, is 47 years old and came to Ohio State in 1987
from the University of Pennsylvania, according to the center's Web
site. She has learned an artificial language system and understands the
numbers zero through six.

Holland said it was the only attack he knew of at the Chimpanzee
Center, which was founded in 1983 and has five adult and four
adolescent chimpanzees. Researchers study them to learn about child
development, comparative psychology, animal behavior and neuroscience.

Ohio State will close its chimpanzee research facility within two
months and
retire its nine residents to a refuge in Texas, the university
announced
yesterday.

But the psychologist who has spent her career using the chimpanzees for
learning research criticized the decision as well as plans to send the
animals to the refuge.

"They're not rats. They're the most significant group of chimpanzees in
the
world," said psychologist Sally Boysen.

The university made the decision to close the facility off Godown Road
after
research funding dried up and it appeared no more money was coming.

"Chimpanzee facilities all over the country are phasing that work down.
It
is very, very hard to get research support for those programs. The Air
Force, NASA, the (National Institutes of Health) are all looking for
homes
for their animals," said OSU spokesman Earle Holland.

Boysen said she learned of the university's decision yesterday.

"I was blindsided," she said.

Boysen studied how chimps learn, making comparisons to how children
learn.

A female chimp bit a student worker on the arm on Jan. 15, but the
university said that had nothing to do with the closure.

The nine Ohio State chimps will go to Primarily Primates Inc., near San
Antonio, Texas, as soon as the refuge is ready to take them.

The 75-acre facility takes in animals, mostly primates, that were
formerly
used in labs.

The OSU chimps could go as early as next week or in up to two months,
according to William Yonushonis, who oversees animal research at Ohio
State.

The chimpanzees will not be subjected to experiments at the refuge in
the
Texas hill country north of San Antonio.

But Boysen said Primarily Primates is not acceptable for the OSU
chimps. She
said the facility will not be able to properly care for the animals.

"Primarily Primates may as well be classified as a roadside zoo," said
Mary
Beth Sweetland, director for research and investigations for People for
the
Ethical Treatment of Animals.

PETA said that when officials with the animal-rights group visited the
Texas
refuge, they found it didn't have enough shade for chimps in cages.
PETA
also said the animals were not fed fresh fruits or vegetables, and that
the
chimps had no toys or other items for stimulation.

Primarily Primates officials could not be reached for comment.

Yonushonis, however, defended the facility, saying he twice visited
there.
He said it also was examined by a veterinarian experienced with
laboratory
animals.

"At one point, we considered dividing the colony and shipping the older
animals to the refuge, but experts have advised seriously against
dividing
such a long-standing colony," said Robert McGrath, senior vice
president for
research at OSU. "We believe it is best for the animals' welfare to
keep
them together as a single social group."

Ohio State will pay $324,000 to construct two 25-foot-by-40-foot
indoor-outdoor structures that will be 17 feet high to house the nine
chimpanzees at Primarily Primates.

The university also will provide an endowment of $72,000 to care for
the
animals for the duration of their lives there.

The nine OSU chimps range in age from 5 to 47; the average chimpanzee
lives
about 60 years. Yonushonis said they will have five times more space at
the
refuge than they had at Ohio State.

Bill Jasso is Vice President of Public Affairs for the Northeast Ohio Division of Time Warner Cable, the nation's second largest cable television company. Jasso has a B.A. from The University of Akron, and an M.S. in Communications Management from the Newhouse School of Public Communications at Syracuse University. He is a graduate of the Federal Emergency Management Agency "Crisis Management" and "Public Information" schools. Bill is professionally accredited by the Public Relations Society of America, and is a past PRSA Chapter president.

Bill was recipient of the 2003 Pinnacle Award, presented by the Great Lakes Cable Association. His board memberships include: the Cable Television Public Affairs Association, Summit Education Initiative, Kent State University’s Public Relations Professional Council, and the Public Affairs Committee of the Akron Chamber of Commerce. He is a graduate of Leadership Akron, and chairs the annual Orientation Retreat. Apparently due to a shortage of “J” surnames, Bill is profiled in the inaugural edition of “Who’s Who in the Media and Communication,” and the Millennium Edition of “Who’s Who in America.”

CANTON Margaret Hughes first noticed a gray cat in her 10th Street NW
neighborhood about two years ago.

Tugging at her heartstrings, the feline cried for attention and begged
for something to eat.

Unable to resist, Hughes set a food bowl outside her house. A pillow
and blanket were tucked into a wicker basket for a bed. She named the
cat Ghost, and limited the animal to the outdoors since she had an
indoor cat.

Another cat entered the picture later. She fed that one, too, once in
the morning and once in the late afternoon.

"I was just trying to save the cats from starving to death," Hughes said.

Then the 69-year-old got a notice from the Canton Health Department on
Jan. 6 ordering her to stop feeding the cats and to remove the bed. If
she doesn't comply by Monday, Hughes would be expected to show up for
a hearing, and could face up to a $100 fine and 90 days in jail, said
Law Director Joseph Martuccio.

"They always seek voluntary cooperation," Martuccio said.

Hughes, meanwhile, sees little harm in feeding the cats, saying she's
"trying to do something humane."

"I felt bad for the cats because they're on a porch meowing," she
said. "They're hungry, and I fed them."

Still, Hughes said, she's complying with the order, removing the food
bowl and bed.

The Health Department says nobody should feed stray cats. Jack Wade,
staff sanitarian, said he understands that Hughes and others think
they're doing a good deed by feeding wandering cats.

Canton Health Commissioner Robert Pattison agrees. "Everybody wants to
help animals, but if you really want to help them, you want to give
(them) a real home."

Food dishes can attract raccoons, skunks and rats, he said. Food left
for cats also can lead to a colony of the four-legged creatures, said
Jackie Godbey, assistant director of the Stark County Humane Society.

The city and county health departments do not pick up strays. Neither
does the Stark County dog warden's office, which refers inquiries
about stray cats to the Stark County Humane Society.

The Humane Society accepts cats and puts them up for adoption, Godbey
said.

"They are the most important resource we have for cats," Wade said of
the agency.

People who have strays or want to get rid of a cat should not dump
them in rural parts of the county, Godbey said.

"They'll see a barn, a farm and they'll take (cats there), and they
don't think that 800 people have done that (in the same area) over the
years," she said.

The Ohio Supreme Court is the first state supreme court to hear arguments on the constitutionality of private-to-private condemnations since the Kelo decision, so in recognition of the occasion, we're holding a rally in Columbus the morning of our argument.

The rally will begin at 8 a.m. on the west plaza of the Statehouse by the large McKinley monument. If you are driving, we urge you to be parked and at the rally site by 7:45 a.m. The best parking is the Statehouse underground parking lot, which is inexpensive and conveniently located. Directions can be accessed here.

For those of you in the Cincinnati and Cleveland areas, we will have a 56-passenger bus coming from each city . YOU MUST RSVP TO RESERVE A SEAT. Please respond to hq@lpo.org ASAP with which bus you will take and the names of those coming with you. If you don't RSVP and show-up for a ride on the day of the rally, you may get turned away if the bus is fully reserved. Please do not RSVP for more than the number of people you are certain will attend with you.

Here are the pick-up locations and pick-up times:

Cincinnati area: 3935 Edwards Road, Norwood, OH 45219. Pick-up at 5:30 a.m.

Cleveland area: 18615 Detroit Avenue Extension, Lakewood, OH 44107. Pick-up at 5:00 a.m.

There is parking available at both pick-up locations. Please be early - the buses will leave at the listed times and will NOT wait for latecomers. The buses are equipped with bathrooms. Both buses will arrive in Columbus at 7:30 a.m. and drop-off passengers at the Hyatt across the street from the rally site, where folks can keep warm until the rally begins. Breakfast will be served on the bus. The buses will depart Columbus at 2 p.m., giving you ample time to have lunch following the argument.

The courthouse is located a block west of the Statehouse. We will depart from the rally site for the courthouse at 8:30 a.m. sharp . Our oral argument is expected to start at 10:30 a.m., and while that time could move up, it's important that you are in the courtroom by 9 a.m. to ensure that you have a seat. Seating in the courthouse is on a first-come, first-served basis. Everyone entering the building will need a government issued photo ID card. An overflow room where people can watch the argument on television will accommodate those unable to be seated in the courtroom.

After oral arguments, we invite you to come to the Hyatt at 75 East State Street - just a block from the courthouse - to hear from the Institute for Justice attorneys who argued the case. If you are taking one of the buses back home, you are welcome to relax in the conference room we have reserved at the Hyatt until 2 p.m.

We encourage you to make and bring signs in support of the Norwood property owners and against eminent domain abuse, but no sticks or poles are allowed. All raised signs must be on cardboard tubes or some sort of light, non-threatening materials.
