In a stunning stroke of abuse of power and arrogance and demonstrating a massiv disregard or ignorance of the Separation of Powers Doctrine of the US Constitution
Deer Leader is pressuring the SCOTUS to reject a petition for certiorari filed by 14 Ex Gitmo detainees. These 14 Chinese Uighur are seeking their release and have sought the favoe of the Unites States Supreme Court using all lawful means.
However once again mimicking George W. Bush precisely Dear Leader, has taken it upon himself to determine who shall and shall not have Constitutional protections and to what degree.
Taking the same stance as the Bush administration, the Obama administration argued in its reply brief [text, PDF] that although the Court has the power to order the release of detainees, it cannot order them released into the US.
Apparently these 14 People are not even detainees. However the Administration will not allow them to leave Gitmo. They are stranded on the island and no country will take them and the Administratin will not provide them passage to any place. They are worse than prisoners. They are castaways. The new form of torture.
Dear leader claims that these 4 people bveing stranded on the Island at Guantanamo Bay is not unlawful detention. He claims it is the “consequence of their lawful exclusion from the United States.” And he claims that he has the power to make them castaways for life as president of the Unites States.
They are no longer detainees they have been released.
Yet Deer Leader insists on the power to grind them under his arrogant heel inflicting punishment isolation and privation upon them and all just because he says so.
These 14 are also seeking Asylum because they fear persecution if they return to China. They are asking for a temporary asylum status while their relocation is undertaken.
What is the reason for this horror being visited on people whose innocence is so obvious that no charges were ever filed and their were
”released” from Gitmo detention only to be abandoned as castaways on a virtually desert Island?
Dear Leader has determined that thse 14 Chinese Uighurs are not unlawful enemy combatants under 10 USC § 948a but, claim they are somehow linked in some vague unexplained way with the East Turkestan Islamic Movement, a militant group demanding separation from China.
