Kansas’ Supreme court holds State law banning funeral picketing is unconstitutional.

The Kansas Supreme Court held (here: tinyurl.com/yq3s3q) just this last Tuesday that the state's new anti-picketing law which protects funerals from assholes showing up to heckle (PDF: www.kslegislature.org/bills/2...244.pdf) (supplement PDF: www.kslegislature.org/supplem...244.pdf) is unconstitutional, because of a separation of powers problem found impliedly in the (here: tinyurl.com/yqffp5).

The court looked to Quo Warranto to hold that the was unenforceable until after the Court ruled on whether it violated separation of powers.

The idiots from the Westboro Baptist church (here: tinyurl.com/bikk) JURIST news archive], spurred this action because of their picketing and heckling persons attending funerals.
‘Thirty plus other states have passed similar laws in response to the group, and a Newly passed Fed law (the bill is here: tinyurl.com/28emho) which limitsd protesting at national cemeteries.
