just recently purchased a pair of fringes from the website. They shipped them to the wrong person (same last name as mine, but that's all). Once I found the error, I wrote them, the response was fairly prompt, they said they sent the person a label to forward them to me when she received them (question, why should I have to wait to get them forwarded, it was their mistake???) She received the pants on 10/5/09 and the new tracking number has never been scanned in the UPS system, so obviously after 14 days, she intends to keep them and not forward them on. I have written asking for another pair of pants, (after all the fault was not mine, why should I be out my money??), or my money back or I would have to file a claim with mastercard to get my refund, after 5 days have heard nothing from Melodia, so I guess a fraud claim through mastercard is my only option. By the way, Kathy Alexander in South Carolina, if you are on tribe, keeping things that don't belong to you is STEALING!! I hope you wear them for a performance and have a blow out on stage and your rear-end gets seen by all.........how's that for bitchy??? LOL.......anyhoo.....customer service is definitely lacking and I guess that's the last time I'll purchase anything from Melo. I'll stick with buying used from ladies on tribe who've obviously have had better luck than I.

Tue, October 20, 2009 - 5:03 AMWhile its bad karma and definitely unethical, it IS legal to keep items that were shipped to you though you didn't order them. It is the responsibility of Melodia Designs to ship you replacement pants ASAP since you paid for them in good faith and it was their shipping error. Likewise, it is the responsibility of Melodia Designs to try and get the misdirected pants back from Kathy, as it was their error in the first place.
If it were me receiving the pants in error I would do the ethical thing and return them, but technically, she is within her rights to keep them.
I had someone ship me a large flat screen plasma TV once that I most assuredly did NOT order. I did the ethical thing and returned it unopened (much to the relief of the company that had shipped it to me in error I'm sure) despite the fact that I could have kept the then $8000 item. I guess I'm an odd duck--my friends and kids were all trying to get me to keep it.
I would try phoning Melodia at her company number and seeing if you can get any resolution that way. If you still get no response, I would imagine that they'll notice the fraud investigation from your credit card company! -

Wed, November 18, 2009 - 9:29 AMSame laws where I live - you get a commercial sending you did not order: you can keep, destroy, resale it, whatever you want to do with it. (the reason behind this is to curb shady business tactics where people would get items they never ordered, with a bill to follow substantially later - "forced purchases", or fraudulently concluded ones, so to speak).
So quite unfair to have that person's name listed on tribe, where posts cannot be deleted I think..

This is THEIR mistake, not yours. You DO NOT have to wait for the "other person" to return the item (unless it's a custom one-of made especially for you). They SHOULD have shipped you a replacement immediately.
Call them or send them a letter - old fashioned written on paper snail mail kinda letter - telling them that if you do not have your pants in five business days, you will take legal action, starting with removing the charge from your card.
As for the person who received your pants -- US Federal Commercial Code says that if a company ships you something you did not order, it is considered a gift. The recipient is under NO obligation to pay for it or return it.
Yes, this rule presents a problem, especially when something like boudoir photos or custom items are delivered to the wrong address! But the rule is there because unscrupulous companies shipped merchandise out at random, then demand the recipients pay for it, or ship it back and pay a "restocking fee". This rule ensures that if you get something you did not order or ask for or want, you will not have to pay for it or go through the hassle of returning it.
So while it would be nice if Katy returned the pants, she is under no legal obligation to do so. This is not her mistake or problem, it is the vendors mistake and problem - and their responsibility to resolve it promptly.

Tue, October 20, 2009 - 7:44 AMActually Melodia sent her a label to do the re-ship to me, so she would be out nothing except her time to add the label and call UPS, and your right, I know she's under no obligation, but its still wrong, ethically anyway. Anyhoo, someone from Melodia has contacted me and asked that I call them today, which I will shortly because of the two hour time difference. Will post how it is resolved. There is a really sad thread on their own tribe about the problems, its a shame really. Hope things change. -

I liked the look of the pants and was considering buying a pair, but for that much they'd better hold together for years (like my UFOs)--and from what people are saying, they don't hold together for months.

Wed, December 2, 2009 - 9:10 PMThe whole thing is really interesting. I have a pair of black sashes that I bought about 2 yrs ago (maybe more) that I love - a bit long but are fantastic. My other sashes are good and I recently during the $48 sale bought a pair of minis - same size but they are significantly smaller than the last two pair (all allegedly size large) and I did notice the uncovered elastic waistband. I probably should have have bought the fringes when I was tempted since they are no longer going to carry that style. Or maybe find someone new who will do something like that. Given that I know so many people who absolutely love Geisha Moth and Katherine Crowley (and I have been eyeing me some Sampants) I will probably move in that direction for when I want really fancy pants (rather than the practice pants that I have made for myself) -

Thu, December 3, 2009 - 7:54 AMI own like 3-4 pairs of Geisha Moth pants and they are indeed fabulous. What I like the best about her designs, though, is that she caters to all sizes and shapes. They go from like XXXS to XXXL in size and then the inseam goes from like tiny to super tall. As an example, I wear a size M/P (P = Pint as an inseam) whereas I wear a size XL in Melos and their inseam is nowhere near my shortness...
I own a pair of stripey sampants by Kathleen Crowley and love them. I recently bought a rattie tattie skirt and it's very fabulous.
