Then he makes dawg-tacos out of invisible Monica and feeds them, to the invisible 1st daughters, to the delight, of invisible straw-bama, who eats any pooch the pubs defile, as part of his sold-out performance, in the White House.

And THEN, Clint (82) needs to get on the piano, for some timely Borge-breaks, before invisible Michelle figures out how the underlying game has been going. Watch out, doggies. Who is worse, at dogging, pubs or D-rats?

What's wrong with the EXXONOMY is crime pays. D-rats sold drug and alcohol laws, to deflect how they were really putting a lot of cars on the road, to run on GASOLINE.

What is wrong with Bush is he knew the 911 attack was coming, so he memo'd the FBI and CIA to stand down, at sharing intel, August 2001. This caused 3400 dead, on 9/11/01.But only ONE war wasn't enough.

So GW ignored the CIA, UN, Joe Wilson, and whomever, to enlist a lying Iraqi informant, per Op.Curveball, so GW, Cheney, Bolton, and whoever LIED, in all directions, claiming Saddam had WMDs and yellowcake, to get a 2nd war.

GW knew Saddam didn't have any WMDs, but the US invaded Iraq, disbanded Iraqi armed forces, while failing to secure ordinance, and then the US privatized Iraq's oil. Got an insurgency?I reckon so!

Lots of boom-boom went off, too. And then when Joe Wilson criticized the Bush Administration, not enough, too, all Cheney's rats got together, and Dick Armitage approached Robert Novak, about how Valerie Wilson worked, for the CIA. Karl Rove confirmed to Novak, how Mrs.Wilson worked, for the CIA. Scooter Libby lied, to investigators, so he got busted and sentenced, but GW commuted his time, not the fine.

Tell you what. Along comes President Obamney, who copied pub ops, so GW and Cheney and Rove are all walking. But torture is still happening, with the Afghan War and a lot of drone strikes, more than 2x the rate, of GW Bush's droning.

Whistleblowers sure are catching heck. Pot clubs are getting busted, more than 2x the rate, of the GW Admin.

I don't have a dog, in the race. If I had one, the pubs would defile the pooch, and the Obamnist D-rats would EAT the pooch, without even going, to Indonesia, first.

This was the media, which laid the foundation, for the April 26, 2012 Joe Biden speech, wherein Barack Obama is declared, to have a 'big stick.'

This was the lead-in media, for Biden's endorsement of same-sex marriage, which outed Barack Obama, forcing the President, to the same media, May 9, one day before the bullygate story broke.

What really happened was these clowns were partial to a vegetable, known as the "LEEK," which suggests the Mitt Romney bullygate story was coming down the road, to be published in the Washington Post, May 10, 2012. The Democrats may have planned to support gay marriage by the election, anyway, but the bullygate story forced them out, early. White House flak Jay Carney was also implicated, since his name suggests MEAT. Of course, so does Mitt.

Democrats didn't break for USCA 4 security. They still let North Carolina and every other state submit measures, for voters to approve class incursions like bans and sentence adjustments, which exceed USCA 5/14 due process and equality specifications. So there are no heros, here.

What happened is the two top clowns in the White House and Veep House planned all this, knowing Mitt was busted, big-time, and he won't get to talk economy, with everybody listening, as well as they would, if he were not implicated and a liar, claiming he cannot remember what happened in 1965, when as a senior in prep school, he led a gang of his fellows to assault and pin suspected gay junior John Lauber, while young Romney cut his blonde, sweep hairdo, with scissors. Romney also harassed another student, who was suspected of being gay.

No cause for alarm! Obama still is a schmuck, who announced to governors, public healthcare was off the table, and his 2700 page Obamacare would promise to tie up courts and Congress, for years to come. He still killed more people with drones and busted more pot clubs, in four years, than GW Bush did, in eight years. He still bailed the banks, but he didn't re-regulate those, courts, or energy, which Bill Clinton deregulated and left in turmoil. He signed the NDAA, and he let ATT off, when it was caught spying on Americans, and then he had Mick (sticky fingers) Jagger over to the White House, when every President since Nixon knew Mick's Rolling Stones were ripping US citizens!

What a schmuck! Obama will get to be President, again, since bullygate is too awesome, to deny, but Romney is trying to say he cannot recall.

The Democrats have been wanting this sort of Joe Mo-mentum, since Joe Montana stumped unsuccessfully for kiter Michael Dukakis, in 1986. If they managed to legalize Santa Claus, they'd have Ho-ho-ho-mentum. Don't expect them to actually legalize something pertaining to equality. They didn't really plan to get all the way there. That would require the USDOJ getting busy, against states which vote on illegal bans. And Obama is too busy keeping the drug war going, with his DOJ.

After all, if the Democrats had tried to pass CO2-neutral biomass research in 2008, they might have gotten this passed. But they lost the House in 2010, and when this was voted on this year, it lost. We still have a drug war and a huge carbon footprint and no legal industrial hemp. Obama is hemming and hawing on the Canada pipeline, while controversy earns lawyers and frackers more money.

We are headed toward bankruptcy, from his Zionist adventures, which are doing exactly what bin Laden wanted, tie us up, for years and years. We support Israel, when Zionism has been the source of murder in the Middle East and around the world, since the Habirus stoned Moses, in the 14th Century B.C. Christians still violate the separation clause and standing army clause, by Zionist conspiracy, but they are too stupid to believe in global warming or acidifying oceans, from their conflict, while they wouldn't want Jews to move in, next-door.

Barack still has the same first name, as an ancient Israelite general. He will smarten up, or we will pay with fire and blood. Some will bite the big one, as in, they will DIE.

The study of the world's surface temperatures by Richard Muller was partially bankrolled by a foundation connected to global warming deniers. He pursued long-held skeptic theories in analyzing the data. He was spurred to action because of "Climategate," a British scandal involving hacked emails of scientists.

"Hate speech? Incitement to violence? Sounds like it to us, but a knowledgeable Muslim would have to disagree.

Why would Muslims not consider this to be hate speech? How is it that we can post these quotes with full certainty that CAIR won't be contacting the media (or Congress) with wild-eyed accusations of Islamophobia?

Well, for one thing, we don’t actually agree with any of these disgusting statements, of course. No one should be harassed for their religious beliefs (or lack thereof) much less physically assaulted.

But the real reason is that we don't fear CAIR is because Muslims themselves honestly believe these quotes to be the literal, eternal word of Allah. In fact, CAIR is promoting this hate speech on their own website! It is actively propagating the very literature that contains these comments, even while sanctimoniously claiming that it is working against hate and violence.

Well, if you haven’t guessed it already, these are quotes from the Qur’an in which we've replaced the word ‘Christian’, ‘Jew’ or ‘unbeliever’ with the word ‘Muslim.’

Here is how they actually appear in the literature that groups like CAIR are pushing:

Sura (8:55) - Surely the vilest of animals in Allah's sight are those who disbelieve

Sura (48:29) - Muhammad is the messenger of Allah. And those with him are hard (ruthless) against the disbelievers and merciful among themselves

Sura (9:30) - And the Jews say: Ezra is the son of Allah, and the Christians say: The Messiah is the son of Allah... Allah (Himself) fights against them. How perverse are they!

Sura (8:12) - I will cast terror into the hearts of those who disbelieve. Therefore strike off their heads and strike off every fingertip of them

Sura (9:123) - O you who believe! Fight those of the unbelievers who are near to you and let them find in you hardness

Sura (5:33) - The punishment of those who wage war against Allah and His messenger and strive to make mischief in the land is only this, that they should be murdered or crucified or their hands and their feet should be cut off on opposite sides or they should be imprisoned; this shall be as a disgrace for them in this world, and in the hereafter they shall have a grievous chastisement

These verses come from five different places in the Qur’an. There are dozens of others scattered throughout that advocate violence in open-ended fashion. There are hundreds more that speak of hatred and hell toward Christians, Jews, and other non-believers. (Is it any wonder that the Muslim world is split largely between those who tacitly support Islamic terror and those who do nothing about it?)......."

"Imagine this scenario: You're pro-choice and you attend a debate between two candidates for office on the issue of a constitutional amendment to criminalize abortion. The first candidate argues that abortion is murder, and if a doctor performs an abortion on a woman, both of them should be charged with first-degree homicide. The second candidate then rises in rebuttal, saying, "No, if a doctor performs an abortion, only he should be charged with first-degree murder. The mother should be charged with negligent homicide."

Would you feel represented? Of course not. But that's what has happened with the debt ceiling negotiations.

It's easy to take shots at the Tea Party-controlled Republican leadership for holding the American economy hostage to fulfill their extreme-right, not-supported-by-the-American-people obsession with cutting spending, and how their alleged concern over debt is really a smokescreen to fundamentally change American society, returning the country back to the 1920s when corporations and the wealthy were allowed to run amok and there was no social safety net for everyone else (leading, of course, to the greatest depression of the 20th century). I did just that last week.

But what has me so angry right now is the news of Harry Reid signing off on a compromise to the debt-ceiling clash that is, in essence, a complete capitulation to the Tea Party position. I have never been so pessimistic about the state of our political process and the future of the country.

I have one simple question: Where are the Democrats?....."

We lose $100 billion every year in federal revenue from companies and individuals who stash their wealth in tax havens off-shore like the Cayman Islands and Bermuda. The sum of all the revenue collected by the Treasury today totals just 14.8% of our gross domestic product, the lowest in about 50 years.

In the midst of this, Republicans in Congress have been fanatically determined to protect the interests of the wealthy and large multinational corporations so that they do not contribute a single penny toward deficit reduction......"

"Surely you have heard that the Republican-controlled House of Representatives has voted to reinstate the Global Gag Rule that prevents any family planning agencies that provide information about abortion service from receiving any U.S. foreign aid.

Who gets hurt? Women, children and anyone who believes the conversation about women's issues needs to move forward.

But once again, that conversation has been hijacked by the right-wing strategy to frame deeper issues related to women and families in terms of a women's right to choose. For a refresher, let's look at the vote by Michele Bachmann and others on the right to defund Planned Parenthood -- even though abortions only make up 10 percent of the services it provides to women without other means of health care, and that abortion services receive no federal funding. As we wrote before:

I know of one woman, in fact, whose life may have been saved by Planned Parenthood. She discovered a lump in her breast shortly after losing her work-related health insurance. Where did she turn for a mammogram? Yep, Planned Parenthood, which ultimately shepherded her through the scary process of not only the diagnostics, but ultimately surgery, chemo and radiation.

The Global Gag Rule has been the ball in a decades-long -- and ugly -- game of political ping-pong since Ronald Reagan was in office. Here's a little bit of the backstory, courtesy of the Center for American Progress:

The global gag rule -- first instated by President Ronald Reagan in 1984, rescinded by President Bill Clinton in 1993, re-imposed by President George W. Bush in 2001, and rescinded again by President Barack Obama in 2009 -- prevents U.S. family planning assistance from going to organizations that perform or provide information about or referrals to legal abortion services. What's more, organizations that receive funds cannot use their own money to provide abortion-related information or services, or advocate for liberalized abortion laws. The rule imposes no similar restrictions on advocacy against such laws. When in force, the global gag rule comes on top of the Helms amendment, the 1973 law that prohibits direct U.S. funding of abortions overseas.

Under the global gag rule, these organizations face a choice: either participate in the American right's global campaign to restrict women's rights and access to reproductive health care or lose critical U.S. funding....."

A Republican-led subcommittee approved a foreign spending bill on Wednesday that cuts family planning funding overseas by $154 million and codifies the Global Gag Rule, which blocks all U.S. money to foreign aid programs that provide or counsel women on abortions. "Rep. Barney Frank (D-Mass.) and Rep. Ron Paul (R-Texas) will introduce legislation on Thursday to end the federal ban on marijuana and let the states decide whether to legalize it.

“The legislation would limit the federal government’s role in marijuana enforcement to cross-border or inter-state smuggling, allowing people to legally grow, use or sell marijuana in states where it is legal,” according to the Marijuana Policy Project, which advocates for pot legalization. “The legislation is the first bill ever introduced in Congress to end federal marijuana prohibition.”

More than a dozen states allow the sale of medical marijuana, but the practice is not legal under federal law, leading to confusion and clashes between local and federal authorities.

In March, for example, DEA agents raided two medical marijuana dispensaries in West Hollywood, California, and 26 dispensaries in 13 cities across Montana.

This despite the Obama administration's announcement two years ago that it would not arrest or prosecute medical marijuana users or suppliers who are not violating local laws -- a reversal of the Bush administration's policy that federal drug laws should be enforced even in states that had legalized medical marijuana. Attorney General Eric Holder has said he will clarify the Justice Department's position.

The bill by Frank and Paul comes 40 years after President Richard Nixon first declared a war on drugs. Last week, to commemorate the anniversary, a group of former law enforcement officials unveiled a new report detailing the failures of the government's long battle against illegal drugs and denounces the Obama administration's current drug policies.

"Since President Nixon declared 'war on drugs' four decades ago, this failed policy has led to millions of arrests, a trillion dollars spent and countless lives lost, yet drugs today are more available than ever," said Norm Stamper, former chief of police in Seattle and a speaker for legalization-advocacy group Law Enforcement Against Prohibition.

"President Obama's drug officials keep saying they've ended the 'drug war,'" the LEAP member said. "But our report shows that's just not true."

"A decade has now passed since the Bush-era tax cuts were signed into law, and the topic remains as divisive as ever.

To mark the ten-year anniversary of the tax cuts, extended last year for both upper- and middle-class Americans in a deal to reauthorize unemployment insurance, the non-partisan Center on Budget and Policy Priorities published five graphs illustrating how the cuts have changed America, and will continue to do so in the future.

What they find is unevenly distributed benefits. The percentage increase in after-tax income tilts greatly in favor of those making over $1 million, for one, especially when compared to Americans making between $40,000-$50,000. And at a time when the country is sunk in $14.3 trillion worth of debt, it's adding vastly to deficit, too. Indeed, the cost of the upper-income tax cuts is roughly equal to the Social Security shortfall in that span, CBPP says.

Criticism of the tax cuts has not died, either. In a blog post this week, Roger Hickey, co-founder of the Economic Policy Institute, for example, called the cuts "another experiment in conservative voodoo economics." And even some of those who've benefited most from the cuts now view them unfavorably, specifically the roughly 200 "Patriotic Millionaires" that recently wrote a letter to Congressional Republicans asking that their taxes be raised to help deficit reduction, rather than relying alone on cuts in government spending.

The secret documents reveal a well developed plan that advocates secrecy, an incremental approach as not to alarm the public. The document clearly states, that the plan is to prevent US efforts to protect citizens from terrorism or disease from interfering with commerce and other financial interests. The documents also advocate that promotion of this plan focus on "individual firms, industries or travelers, and
especially consumers" instead of the nations as a whole.

This high level leak appears to validate earlier concerns by many groups of plans to create a new government, which would supersede the sovereignty of America, Canada, and Mexico in a way similar to the European Union. Critics of these merger plans call the plan the North American Union. Supporters of the plan call it the North American Community or North American Integration (NAI).

"It is conspiracy, but it is no theory," said William Gheen of ALIPAC. "These traitors are trying to conceal their plans, but they are out in the open now. They are trying to force an economic union on America that is not ratified by the US Congress, not authorized by the US Constitution, and not approved of by the American public. This plan is being facilitated by the nonenforcement of our existing immigration and border laws."

Americans were shocked to learn in 2005 and 2006 that millions of illegal aliens had been imported into America and were now marching in the streets demanding legalization, citizenship, voting rights, and taxpayer resources. Federal lawmakers loyal to the North American Integration plans have claimed "our immigration systems are broken" when in fact the immigration systems have been compromised by those advocating a merger of the populations of America, Mexico, and Canada.

Other examples of this economic union plan which has been pursued by Presidents Bush and Obama, can be found in the writings of Dr. Robert Pastor of American University, in releases by the Council on Foreign Relations such as "Building a North American Community," and in announcements made by heads of state in all three countries supporting the Security and Prosperity Partnership (SPP).

Kansas Anti-Abortion Bill Could Also Block Planned Parenthood Funding

"WASHINGTON -- The Kansas state legislature passed a bill early Friday morning that bans insurance companies from offering abortion coverage in their general plans in most cases and manipulates the state budget to cut all Title X family planning funding from Planned Parenthood.

The new Kansas bill places Planned Parenthood at the very bottom of the priority funding list for family planning funding under Title X, a federal grant program that funds reproductive health services for low-income and uninsured patients. Planned Parenthood of Kansas and Mid-Missouri currently receives $334,000 a year in Title X funding, all of which it uses toward preventative health care, including pap tests, cancer screenings and STI testing and treatment, according to the health care provider.

The bill is part of a nationwide effort by the states to strip Planned Parenthood of government funding, which conservatives say is being used to pay for abortions, though the Hyde Amendment has outlawed federal funding for abortions for the past 30 years.

“The fundamental issue here is not -- although I wish it were -- the ability to further limit legal access to abortion, but rather who pays,” said Kansas House Judiciary Committee Chairman Lance Kinzer (R-Olathe).

Since Republican congressional lawmakers failed to defund Planned Parenthood during federal budget negotiations in April, state lawmakers have been busy figuring out ways to cut funding to the family planning provider without explicitly doing so. Indiana Gov. Mitch Daniels (R) signed a bill earlier this week preventing Medicaid from contracting with “any entity that performs abortions” aside from a hospital, which effectively singled out Planned Parenthood.

The Kansas bill could leave thousands of rural and low-income patients without access to affordable health care. A 2009 report by the Guttmacher Institute found that a majority of low-income women consider a family planning center like Planned Parenthood their primary health provider. Moreover, Planned Parenthood estimates that 73 percent of its clinics are in rural or medically underserved areas, where patients have very limited options for affordable health care.

“This amendment will be disastrous for thousands of Kansans, particularly those living in rural counties," said Peter Brownlie, president of Planned Parenthood of Kansas and Mid-Missouri. "By effectively eliminating Planned Parenthood as Title X provider, patients may be forced to endure long wait time for live-saving cancer screenings and the possibility of having to drive hundreds of miles to the nearest low-income family planning provider,” he said. “This amendment is an attack on poor women, and it is repugnant.”

State legislatures across the country, including Indiana, Texas, North Carolina, Oklahoma, and Tennessee, are considering or have passed bills that would cut off funding for Planned Parenthood, but not without resistance. The Indiana branch is fighting back against the state's defunding bill in federal court, and the Planned Parenthood of Kansas may now do the same.

“Planned Parenthood of Kansas and Mid-Missouri is seriously considering all options -- including litigation -- to protect the health care needs of our patients, particularly low-income women and families,” Brownlie said in a statement. “There is no question: If the measure acts as intended, Planned Parenthood and thousands of patients will be unfairly punished.”

"In Egypt over the weekend, 12 people died and more than 180 were wounded during clashes between Muslims and Christians in Cairo. Egypt’s army has said that 190 people were detained after the fatal clashes and that they will face military trials. Saturday’s violence started after several hundred conservative Salafist Muslims gathered outside the Coptic Saint Mena Church in Cairo’s Imbaba district. They were reportedly protesting over a months-old allegation that a Christian woman was being held there against her will because she had married a Muslim man and wanted to convert to Islam. The woman had dismissed the allegations in an interview on a Christian TV channel. Coptic Christians account for about 10 percent of Egypt’s population. We’re joined on the phone from Cairo by Sharif Abdel Kouddous, Democracy Now! correspondent and longtime senior producer. "This was a major attack," says Kouddous. "What many people, and many Coptic people in particular, do not understand is why the military, who was present at the scene while the violence was happening, stood by while the worst of it took place and did not intervene."

Bin Laden death sparks new talk over Patriot Act

"WASHINGTON – Freshman Republican Randy Hultgren had no problem voting against extending the Patriot Act in February. But the death of Osama bin Laden, just weeks before part of the terrorist-fighting law expires, raises new questions for the Illinois congressman.

"It hasn't changed my mind, not yet," Hultgren said this week. "I want to see that we're doing it in a careful way, that we're seeing results from it."

There's no indication that the mission to take out bin Laden relied on the Patriot Act, which was designed after the Sept. 11 attacks to find terrorists inside the U.S. But the afterglow of the operation's success shined new light on the nature of the terrorist threat nearly a decade after the attacks bin Laden inspired.

Interviews with House and Senate experts on the law, from both parties, indicate this week's developments may have marginalized any effort to tighten the Patriot Act's protections and perhaps scuttled Senate plans to hold a full week of debate on the bill.

From its inception, the law's increased surveillance powers have been criticized by both liberals and conservatives as infringements on free speech rights and protections against unwarranted searches and seizures.

Some Patriot Act opponents suggest that bin Laden's demise should prompt Congress to reconsider the law, written when the terrorist leader was at the peak of his power. But the act's supporters warn that al-Qaida splinter groups, scattered from Pakistan to the United States and beyond, may try to retaliate.

"Now more than ever, we need access to the crucial authorities in the Patriot Act," Attorney General Eric Holder told the Senate Judiciary Committee.

If bin Laden's death has any impact on the law's fate, "I hope...it'll be in the direction of extending the current law," said Senate Republican leader Mitch McConnell. "Most of us believe it's been an effective tool in the war on terror."

The provisions that expire May 27 allow the government to use roving wiretaps on multiple electronic devices and across multiple carriers and get court-approved access to business records relevant to terrorist investigations. The third, a "lone wolf" provision that was part of a 2004 law, permits secret intelligence surveillance of non-U.S. individuals without having to show a connection between the target and a specific terrorist group.

The Senate Judiciary Committee in March approved a bill that would extend the provisions until 2013, tighten its civil liberties protections and increase oversight. But there's evidence that bin Laden's death may have marginalized any such effort to do more than extend the law, as is. A Senate official not authorized to speak for the record said it wasn't clear that there would be a full week of floor debate on the Patriot Act as Majority Leader Harry Reid had indicated.

The law's fate, for now, resides in the Republican-controlled House and the odd pairing of GOP libertarians and Democratic liberals who have long viewed the Patriot Act as an oppressive overreach.

The new Republican majority in February underestimated the mistrust of the Patriot Act and tried to renew it for 10 months under rules that required a two-thirds supermajority. It failed. Instead, the Senate proposed a three-month extension, and House GOP leaders succeeded in passing it with a simple majority, 279-143.

Of the 'no' votes against the three-month extension, 26 came from Republicans. GOP leaders now are looking to a meeting of the House Judiciary Committee next Wednesday to test whether a straight extension, or one with changes, could draw votes from Democrats, too.

That has left the Senate's Patriot Act experts cooling their heels as they wait for the House to write a bill that might pass. On ice is a bill written by Senate Judiciary Committee Chairman Patrick Leahy, D-Vt. Approved by his committee in March with bipartisan support, it would impose tighter standards on the government's access to library and other records and require more oversight of agencies that operate under the law.

Intelligence Committee Chairwoman Dianne Feinstein, D-Calif., has called for a clean extension through 2013. Several Republicans have proposed just making the expiring provisions permanent.

But as the magnitude of the bin Laden operation sank in, questions arose in the Senate as well as the House.

Freshman Sen. Mike Lee, the Utah Republican whose tea party backing helped him defeat incumbent Sen. Bob Bennett in a primary, was the sole Republican to vote for Leahy's bill to tighten the Patriot Act's civil liberties protections and beef up its oversight requirements.

But this week, Lee couldn't say whether he'd vote for it on the floor. He also did not rule out voting for a straight extension.

Leahy's bill "would do a better job of protecting civil liberties and privacy than current law," Lee said in a statement. But, he said, "I will need to see how the final reform package shapes up."

"WASHINGTON - A closer look at a House bill marketed to the public as a "common-sense" ban on taxpayer-funded abortions reveals an aggressive, multi-pronged effort to restrict insurance coverage for and reduce access to abortion.

H.R. 3, also known as the "No Taxpayer Funding for Abortions Act," would go beyond making the Hyde Amendment, which has already banned federally-funded abortions for the past 30 years, a permanent federal law. The legislation, sponsored by Reps. Chris Smith (R-N.J.) and House Speaker John Boehner (R-Ohio), would also enact strict procedural requirements for private insurance companies that cover abortions and deny tax credits to small businesses that purchase health insurance plans offering abortion coverage. Eight-seven percent of private insurance plans currently include such coverage.

Further, H.R. 3 would eliminate privately funded insurance coverage for abortion in the state-based exchanges set up by the Affordable Care Act. The policy team at NARAL Pro-Choice America estimates that 13.5 million women who receive health coverage through Medicaid and other government-sponsored programs would permanently lose access to abortion coverage if the measure, facing a floor vote Wednesday, passes.

Some of the more extreme ramifications of the bill, which have attracted a great deal of negative media attention since its introduction in January, include a provision that could subject victims of rape and incest to abortion audits by the IRS. Mother Jones reported in March that H.R. 3 could turn IRS agents into "abortion cops" tasked with determining whether a woman used any kind of tax benefit to pay for a procedure not precipitated by rape or incest........."

"In a decision earlier this week in Arizona Christian School Tuition Organization v. Winn, the five conservative Justices on the Supreme Court (Roberts, Scalia, Kennedy, Thomas and Alito) carved a large hole out of the Establishment Clause of the First Amendment. Although the issue in the case was subtle, the consequences are not.

The First Amendment prohibits government to make any law "respecting an establishment of religion." A central concern of the Establishment Clause, in the words of James Madison, was to forbid government "to force a citizen to contribute" even "three pence of his property for the support of" religion. As the Supreme Court recognized more than forty years ago, as a general proposition the Establishment Clause prohibits government from using its "taxing and spending power... to favor one religion over another or to support religion in general." Thus, the Establishment Clause forbids government to fund churches to enable them to spread their religious beliefs or to award special tax credits to individuals to reimburse them for their contributions to religious organizations.

There is a complication, however. Even though such government programs violate the Establishment Clause, it is not clear whether anyone can legally challenge them. To bring a lawsuit contesting a law's constitutionality, a plaintiff must have "standing" to sue. To have standing, a plaintiff must have suffered a distinct "injury in fact" as a result of the government action he wants to challenge. Standing is necessary because we want the parties to have a meaningful stake in the outcome of litigation. Otherwise, they might not adequately represent their position, which could result in a waste of judicial resources or, even worse, erroneous decisions.

Usually, this is not a problem. Most constitutional violations create a distinct "injury in fact" to particular individuals. For example, when an African-American child is excluded from a public school because of her race, when an individual is subjected to an unconstitutional search, when a person is arrested for her speech, or when a person is denied the right to vote, there is no question of standing. In such situations, it is easy to see that a particular individual has been harmed.

The Establishment Clause, however, poses a unique dilemma. Many Establishment Clause violations do not inflict a distinct "injury in fact" on any particular individual. Consider, for example, the illustrations I offered above. When government unconstitutionally funds religious organizations or grants tax credits to reimburse donors to such organizations, it is not clear exactly who is harmed -- other than taxpayers. But because the harm to any individual taxpayer is highly attenuated, traditional standing doctrine ordinarily would deny individual taxpayers standing to sue. This is a problem in the Establishment Clause context, because no one else has standing. The ironic result would be that no one would have standing to challenge the constitutionality of an unconstitutional government policy. Needless to say, this is untenable.

To solve this problem, the Supreme Court held in Flast v. Cohen in 1968 that taxpayers do have standing to challenge taxing and spending policies that violate the Establishment Clause. Until recently, federal courts at every level, including the Supreme Court, have consistently and broadly applied Flast to enable taxpayers to enforce the Establishment Clause.

In 2007, however, in Hein v. Freedom from Religion Foundation, the five conservative Justices took aim at Flast. In an opinion by Justice Samuel Alito, they held that taxpayers lacked standing to challenge the constitutionality of the Bush administration's program of faith-based initiatives. As Justice David Souter rightly observed in dissent, the conservatives' argument that Flast was distinguishable because it involved a challenge to a legislative rather than an executive branch program had absolutely no basis "in either logic or precedent."

Two days ago, the same five-Justice majority struck again. In Arizona Christian School Tuition Organization v. Winn, the Court considered a taxpayer challenge under the Establishment Clause to a state program that had provided $350 million in state tax credits to reimburse individuals who had made contributions to organizations that predominantly support Christian schools. In an opinion by Justice Anthony Kennedy, the conservatives held that taxpayers had no standing to challenge this program because it involved tax credits rather than government expenditures. In other words, if the government had given the funds directly to the organizations, the taxpayers would have standing, but because the government instead gave the funds to individuals to reimburse them for giving money to the organizations, the taxpayers did not have standing.

As Justice Elena Kagan explained in a powerful dissenting opinion, joined by Justice Breyer, Ginsburg and Sotomayor, this distinction "has as little basis in principle as it has in our precedent." Indeed, the conservatives' new approach "enables the government to end-run Flast's guarantee of access to the Judiciary." As Kagan observed, under the conservatives' analysis, a state that wants "to subsidize the ownership of crucifixes" can now simply grant a tax credit to individuals who buy crucifixes. That program would effectively be insulated from constitutional challenge, not because it is constitutional, but because no one would be permitted to raise the question..

With their decisions in Hein and Arizona Christian School Tuition Organization, the five conservatives on the Supreme Court have thus enabled government to violate the Establishment Clause at will, by denying courts the authority to declare even unconstitutional programs unconstitutional. In so doing, they have, in Justice Kagan's words, eviscerated "our Constitution's guarantee of religious neutrality."

[He] was listed as an unindicted co-conspirator in the Holy Land Foundation case … against the fundraisers for Hamas, all of whom were convicted."

They include “civil rights activist” Farhana Khera, who Mr. Emerson recounts has discouraged Muslims from cooperating with law enforcement, and retired Cardinal Theodore McCarrick, who is a prominent participant in interfaith dialogues manipulated by the largest Muslim Brotherhood front in the United States, the Islamic Society of North America (ISNA)."

Just when the U.S. Treasury needs the money most, American companies are finding new ways to shift profits to overseas tax havens and legally avoid paying the U.S. tax rate of 35 percent - among the highest in the world.

Those companies say they are doing what they must to compete in the global economy and please their shareholders. But others feel the companies are getting an unfair break by moving business to places like Switzerland and Ireland.

Lesley Stahl reports on the debate for a "60 Minutes" story to be broadcast Sunday, March 27 at 7 p.m. ET/PT."

Jan Schakowsky Introduces Bill To Raise Taxes For Wealthiest Americans

"WASHINGTON -- Rep. Jan Schakowsky (D-Ill.) announced new legislation on Wednesday that would create new tax brackets for earners who make significantly more than the baseline for the current top income bracket.

Currently, the top marginal tax rate of 35 percent applies to income starting at $373,650, and the tax code fails to distinguish between earners making a few hundred thousand dollars a year and those making a few hundred million dollars a year. "LeBron James and LeBron James’s dentist: same difference," New Yorker financial columnist James Surowiecki quipped last year during early debate over the extension of the tax cuts enacted under former President George W. Bush.

Meanwhile, income inequality continues to soar, as Schakowsky, one of the 18 members of President Barack Obama’s debt commission, noted on Wednesday.

“In the United States today, the richest 1 percent owns 34 percent of our nation’s wealth -- that’s more than the entire bottom 90 percent, who own just 29 percent of the country’s wealth,” she said during her prepared remarks at a press conference. “And the top one-hundredth of 1 percent now makes an average of $27 million per household per year. The average income for the bottom 90 percent of Americans? $31,244."

Schakowsky's bill would create new tax brackets for earners making between $1 million and $1 billion annually, with tax rates starting at 45 percent with the millionth dollar and increasing on a sliding scale. The legislation would also tax capital gains and dividend income as ordinary income for those earning over $1 million in a given year. A full list of the new brackets appears below:

$1-10 million: 45%

$10-20 million: 46%

$20-100 million: 47%

$100 million to $1 billion: 48%

$1 billion and over: 49%

"If enacted in 2011, Schakowsky's Fairness in Taxation Act would raise an estimated $78.9 billion in its first year.........."
