costuming controversy

I've been noticing on different tribes about 'knock-offs'. I haven't posted my opinions on other tribes, but I can here without offending the tribe moderator....me...lol.

So, I have to admit, I get inspired by other people, as I'm sure in the past there have been others 'inspired' by me. Obviosly not in the belly dance realm, because this is a new adventure in costuming for me, and I'm hoping it will be a great ride!

I think I have a lot of new and fresh ideas when it comes to costuming. I have worked with a lot of fabrics that are definitely not belly dance types...normally.....hehe...but maybe will be when I'm done with ya! : )

Anyway, I was looking at another tribe and noticed that someone posted about how her design differed from the original.

Someone accused me of 'knocking off 'her design recently( not in the belly dance realm) and I was shocked. She said she was going to sue me as well. I looked on the web to find more 'knock-offs' of this design...lots. She hasn't got the corner on it, nor did she invent it. She was inspired by something herself and created something slightly different, which is what i did. Someone brought me the idea, and we stood there for over an hour to creat it. Pinning this creation to her, then I re -created that.

I was also 'inspired' by the melodia pants. They are a pair of flares with a split in the side. That is the only similiarity. I created a pair of what I called 'trumpet pants, and then recently noticed that someone else is doing the same thing. So who is first? well, I think even though I made mine a few months ago, no one has seen them....so because people have seen hers....hers will be the "original"

It's a weird line to walk, this whole design thing. I haven't really had to encounter this world of 'knock-offs' before, because everything I have been creating for the last 10 years has been one of a kind. It's hard for me to wrap my mind around "mass production". I have so many ideas and designs swirling around in my head that I can't decide which ones to do!!

I will be featuring some Pvc (goth style) pieces at the bazaar this year in the spring, and also some more traditional designs as well.

How about some opinions on this whole mess? : ) I hope this post makes some sense. : )

    Some people are......... "a little tense"......... about anyone 'imitating' their creations.

    However -- Imagine if the first person who made a pair of pants went ballistic whenever someone else tried to make pants! Or shirts.......... or skirts........... or shoes, if you get me!

    If you make something unique, COPYRIGHT IT. Otherwise, I think once it's in the public domain, it's a little too late to say its "yours", isn't it? This is why we have Copyright laws, Copyright lawyers, Intellectual Property law, etc. etc. It's sad to say, and it's a necessary evil, so-to-speak, but Consulting a Lawyer is A Good Business Practice.

    As far as fabrics and MANY other bellydance topics are concerned -- Just because something isn't "traditional" doesn't mean it's bad!

      I agree! We would still be naked.

      I have read about copyright etc...a little, since I was approached. It seems that if there are improvements on said design...it's then a different design. It's funny about 'designs'. Once little tiny change and it's a whole new design!
      So with this girl I mentioned, I'm pretty sure I'm ok. I haven't actually had one of hers in my hand, so there is no way it can be exactly the same. I had nothing to copy from, so in essence it is my design. What is funny though, is that there have been girls that have both mine and hers, and they say mine is better quality. So...go figure! : )

      Personally, I figure as soon as I put it out there for all to see, it's public domain. I know someone is going to look and say hey, I can make that! I'm not looking for fame....now fortune on the other hand..... : )

    Unless somebody has a copyright, i think things are, oh geesh i can't think of the word..
    Like being free ware.. When i took jazz class flared pants were called jazz pants.. Now the same things that i buy are called yoga pants. In the 60's they were bell bottoms.
    I have come to the conclusion, i dance, quilting and fashion that nothing is new. It's all be recycled over and over and over again.. PVC, or pleather is not new either.. I remember it from the 80's.
    I for one love you creations and say keep up the good work. I would be ecstatic if you'd made me a pair of "petite" trumpet pants one day..

      You are so right! The eighties is back now in a big way....just interpreted differently. Same with costumes,it's the same, just interpreted differently.

      This is great! I love opinions.....most of the time...lol

    If your items are not identical, you have nothing to worry about.

    You do beautiful work, you have great ideas, you see something you change something and that becomes your own.

    Did you know that in patented items, if one is able to change ONE thing to make the item better it obsoletes the existing patent? :-)

    From what you said your item has been said to be better!!!!

          I dont know how old any of you are but the FIRST time these were in style was in 1964 or there abouts. They were called bellbottoms and hip huggers and everyone and her sister had their own ideas and designs. I had a closet full of the things and made them in my sewing room by the dozen!

          My teenage granddaughter cant believe me when I tell her about them! "You did not"! did too, did not, did too, did not, too, not, too, not...........

            I'm not so old as to remember the bellbottoms...well not entirely true. : ) I had a pair of bellbottomed jeans when I was 12.

            This has been discussed on many tribes lately and that does seem to be the consensus...that flared pants have been around for a very long time, but the incarnation this time around seems to have been a really big debate.

              Yes, flares have been around for a long time and in the dance world even when the flares were out. Jazz pants have always been know to have flares although a 'bit' smaller.
