I like the idea of a well vetted ID like the NJ driver's license. You can't get one without going through some hoops and the thing is costly to forge.

Huh~? Checked for suitability? You mean the driver exam before they give you a license?

Generally the police should not be demanding ID unless you are stopped driving. Then you haven't got any choice. Driving is not a right.
If you are walking the police need some reason to demand ID. Such as when they think you have or are committing a crime. Any crime will do. Jaywalking: you name it.
I would love to see test case where some guy gets arrested and refuses to identify himself and nothing pops up when they run his prints.
The court would hold him in contempt or simply deny him bail (I'm sure) but if he stuck it out through trial what then?
What if he was acquitted or nolle prossed?
What if convicted? Would the court be able to take a fine from a John Doe or of imprisoned would the prison be able to deal with a John Doe inmate?
It would be most entertaining.
Well at any rate when you hand something over to the cops is is not (by definition) a search and seizure. You handed it over.

Mon, March 10, 2008 - 12:08 PMRight and like the standard law school fare ( I forget the cite) that has some black guy in California refusing to ID himself because he was walking in a ritzy neighborhood, the police need some indicia of criminality. They shouldn't be walking up to you and demanding that you identify for no reason other than it pleased them. And of course if they do you can blow them off - assuming you are willing to risk a beating and being charged for A&B on a PO.
