The things is, *there* *is* *no* money for this program. Real ID is horribly privacy invasive, plus expensive. Even if states wanted to comply (which at least 17 have at least passed resolutions against it), I don't know how they'd pay for it.
A tactical position might be to sign the waiver and then wait and see who's elected. That way people won't get harassed by the TSA. I believe both Clinton and Obama are against it, so if one of them wins, and if legislation repealing Real ID comes their way, it is likely to get signed. If Real ID is repealed, then the waiver doesn't matter.
And one thing still stays with me -- the draft regulations really had a defeatist tone to them. The drafters know they have a program that is defective and expensive.
Another tactic may be to just stand tough and not to blink. I'm almost positive Chertoff will have the TSA harass passengers from states who haven't signed the waiver, but if enough states don't sign the waiver, there aren't enough TSA agents in the country to prevent air travel from halting. Imagine the air traffic snarls if every passenger from California had to be patted down. -

And ( in NJ & FL) if your license is suspended, you can get charged with operating while on the revoked list for using a riding lawn mower in your back yard. In PA you have to be on a roadway to get so charged.
However, we are working on legislation that'll comport with the Constitution while conferring upon the police the right to detain you for the purposes of requiring you identify yourself when ever you are using the sidewalks or being on public property on the thesis that use of public rights of way and facilities is not a right but a privilege.
Before long I expect that we ( that'd be me and my evil cronies) will have you required to wear your ID just like you have to when you are hunting or fishing.
